In the heated primary race for District 5 of Port Canaveral Commissioners, Tom Weinberg is attacking Mac McLouth’s record,claiming voting conflicts, but a closer look at McLouth’s votes reveals the inaccuracy behind Weinberg’s claims. Weinberg has the funds to bombard voters with his message, with $34,920 in contributions from 96 different sources, including many out of county and out of state donors.

Weinberg accused McLouth of voting on matters that impacted McLouth’s employer, but McLouth actually advised his part-time employer not to invest in the gambling ship venture that was impacted by the vote. In McLouth’s response letter,he points out his own self-imposed rule that prevented his professional engineering company from working with the Port Authority. In his response letter, McLouth elaborated on the gambling ships vote.

“Related to his charge of voting conflict, I strongly advised my then part-time employer NOT to invest in the Las Vegas Casino ship venture,” McLouth said. “Later as a commissioner, it was obvious to me that the gaming ship activity in Florida was in rapid decline due to competition from the Native American casinos. I suggested to the Commission that if we wanted to keep this income (and jobs), the Port needed to modify its business plan. My comments were misinterpreted as being biased to the two remaining operations; namely Sun Cruz and Las Vegas Casino Lines. Nothing could have been further from the truth. In the end, all three gaming ship operations at Port Canaveral failed as predicted. As further proof, a revised Port Business Plan has now attracted a proposed gaming ship operation that will yield, at best, only 38% of related past Port income levels.”

McLouth’s base of support is solely within Brevard County, with nearly all of his contributions from donors in Brevard County. has received  $12,225 donations Weinberg’s records show 23 of his 96 donations coming from donors outside of Brevard County, including Banner Elk, North Carolina,Orange Park,Winter Park,Heathrow, Pensacola,Chicago,Suwannee Georgia and Wetumpka, Alabama.

McLouth was elected as a Port Commissioner in 1967 and served through 1996, when he became the director of the Port’s business development and was promoted to executive director, where he served from 2000-2004. During that span, the port enjoyed major expansion in business. He was re-elected in 2008 to fill an unexpired term and is the current President of the Cape Canaveral Council of the Navy League of U.S.McLouth also serves on Metro Plan Orlando, www.metroplanorlando.com

Weinberg is a real estate broker, attorney and former  Chief of Staff for U.S. Senator Mel Martinez. Senator Martinez resigned from the U.S. Senate during his first term in April,2009 and now works as a lobbyist for J.P. Morgan Chase. Top Donors in Port Canaveral Commission Race

As promised, Brevard Watchdog brings you the latest financial contribution reports for the Port Canaveral Commission Race. Two of the most highly contested districts out of the 5 are District 4 and District 5.

Watchdog readers will recall, District 4 is the seat formerly held by former Port Commissioner Ralph Kennedy, who resigned last fall.  Governor Crist appointed Bruce Deardoff as Kennedy’s replacement, and Deardoff leads the district with $30,500.00 in contributions, but the majority of the money came from Deardoff’s own pocket.

  • Deardoff is followed by Randy O’Brien, who has $11,650.00 in contributions, from more than 20 different contributors and only two of the contributors outside of Brevard (Orlando and Jacksonville.)
  • O’Brien is followed by Ralph Hagen, who received $9,260.00, from 34 different contributors, including 15 outside of Brevard County.
  • William Golding, captain of a fishing charter boat at the port, has received $6,396.83 from 13 different donors, including 12 from Brevard, with donations from Kenneth Karpinski has $1,355.97 from 16 different contributors, two of the contributors are outside of Brevard County.
  • William Parker has $1,550, from 10 contributions, all local.
  • Fred Garbotz has $500, from one local donor.

District 5

In District 5, Tom Weinberg is running against incumbent Mac McLouth. Weinberg has $34,920.16 in contributions to McLouth’s $12,225. Weinberg’s records show 96 contributions, with donations coming from national and local sources, including Banner Elk, North Carolina,Orange Park,Winter Park,Heathrow, Pensacola,Chicago,Suwannee Georgia and Wetumpka, Alabama.

Conversely,only three of  McLouth’s contributions come from donors outside Brevard, with the farthest donation coming from the south part of the state, in Jupiter,Florida. The other two candidates are Victoria Anne Barkley, who has no contributions listed on the Brevard County Supervisor of Elections, and Democrat Pete Nichol’s lone contribution is from AFL-CIO, the largest federation of union workers.

For the record, BrevardWatchdogs.com, will never promote a single candidate, but readers are encouraged to consider the major donors to each candidate and the potential influence of each major donor. While out of state tourism dollars are always welcome, the commission should always prioritize the health of local businesses, especially in the midst of record high unemployment and a prolonged national economic recession.

NEWSFLASH….

From January 1, 2008, through December 8, 2009, Bistline’s law firm, was paid $626,996.09 by the Brevard County School board, plus $231,729.68 by the Port (for 2008 only), all in the midst of an incredible economic recession.

• This total sum of $858,725.77 DOES NOT INCLUDE the fees paid by the port to Bistline for 2009.
The Port also spent $182,000 in 2009 for additional legal fees to other legal firms (not Bistline’s firm).
• The Schoolboard paid an additional $90,180.55 for legal fees to other legal firms (not Bistline’s firm) for a grand total in legal fees for the schoolboard for 2008 of $717,176,64.
In the opinion of BrevardWatchdogs.com, our citizens deserve an audit conducted by the Canaveral Port Authority and schoolboard, to ensure that these legal fees charged are fair, considering the current economic recession and the budget gaps throughout Brevard County.

Dec. 23, 2009: Brevard County: Internet-savvy executives and public officials know the importance of monitoring your online reputation. In the world of new media, your public reputation is determined by the top results listed in Google, Bing and Yahoo search results, whether the search results are your content, or various media outlets.

Recently, Stan Payne, CEO of  Canaveral Port Authority and his sidekick, attorney Harold Bistline, have been in the news for all the wrong reasons, including: The Ralph Kennedy investigationstalling on a 119 request, negotiation problems with three different casino lines, including two which left the Port and hundreds of jobs in their wake and dissent from veteran commissioner Ray Sharkey.

The culmination of these issues has eroded the community’s trust in the port and left Brevard County’s citizens wondering, “Are there any checks and balances in the Canaveral Port Authority, or is the commission merely a puppet show for Payne and Bistline?”

Dec. 10, 2010, Brevard County, FL – Port Canaveral Commissioner Ray Sharkey is now demanding answers from Stan Payne, the CEO of Canaveral Port Authority, and Payne’s disingenuous, arrogant and combative sidekick, CPA attorney Harold Bistline.

Commissioner Sharkey is standing up for the public’s right to hear the truth regarding the recent and unexpected resignation of former commissioner Ralph Kennedy. The Port is now rife with rumors as to why Kennedy, a 19-year commissioner, resigned abruptly in late October.

BrevardWatchDogs.com has been the only media outlet to question and hold accountable Payne and Bistline for stonewalling the public, businesses in the port and even the four remaining sitting commissioners.

BrevardWatcDogs.com received a hard copy of  letters sent  from Commissioner Sharkey to  Payne and Bistline, in which Commissioner Sharkey urged Payne and Bistline to come clean and answer questions, (see the Letter #1 below) and lift the veil of secrecy. Payne has yet to respond to the letter, which Payne received on Nov. 30.

Commissioner Sharkey said that he has been left in the dark, just like the public, regarding the Kennedy resignation. As our growing audience already knows, “Benedict” Bistline has repeatedly attempted to stall BrevardWatchDogs.com’s access to pubic records via our 119 request to Canaveral Port Authority

For several weeks, Payne, who was appointed by the board of five elected commissioners, has refused to shed light on the unexpected and abrupt resignation of a commissioner who served the port for 19 years.

As you’ll see in Commissioner Sharkey’s letters below, the veteran commissioner shares BrevardWatchdog.com’s concern for protecting the integrity of the port via  accountability, transparency and open communication with the public.

Like BrevardWatchdogs.com, Commissioner Sharkey calls into question Payne’s legal authority, and the commissioner should be applauded and commended for coming forward to expose the power-crazy mutineers who are running roughshod over all who attempt to hold them accountable for their abuse of power and over-stepping the authority vested in them by the commission.

The Bistline – Payne “tag team” blatant lack of accountability and secretive conduct is increasingly jeopardizing OUR Port’s integrity and reputation with each passing day, due to their failure to provide information to the public. All Brevardians who depend on the health of our local economy, of which the Port is a major driver, are very concerned that our lucrative cruise ship and cargo business will be put off by Payne and Bistline’s disingenuous conduct.

Some of the BrevardWatchDog.com’s readers (who are long-time Brevardians) have suggested that Payne is nothing more than a “Carpet Bagger” using OUR Port as a stepping stone to more lucrative opportunities. That may be evidenced by, as anyone who pays attentions knows (including the hard-working port staffers), Payne loves to hog ALL the credit for the Port’s cruise ship business and overall success.

However, as Commissioner Sharkey so aptly and accurately points out in his letter to his fellow commissioners, Payne and Bistline dated Oct. 18, 2009, it was the Port’s early pioneers and the many dedicated staffers and employees (past and present) who have made the Port what it is today. Payne has simply been the beneficiary of being in the right time at the right time to reap the praise of success. (See Letter #2 below).

In our opinion, Bistline has been around TOO LONG, and, as one of the county’s elder “Good-Ole-Boys,” he thinks he can manipulate, circumvent, intimidate and outright bully the public without consequence. It’s disconcerting to know that this gentleman is also the attorney for the public entity most responsible for the development of our children: the Brevard County Schools.

In talking with the public, the small businesses in the ports (and community) and other public officials and staff, we believe that there will soon be a groundswell for Mr. Payne’s and Mr. Bistline’s resignation if they don’t begin to cooperate IMMEDIATELY with their bosses: the CPA commission, AND the public in Central and North Brevard who elect those commissioners.

BrevardWatchdogs.com has received the overwhelming support of our community (including several port employees) urging us not to let Payne and Bistline bully and intimidate us in our quest for total accountability. Canaveral Port Authority Agrees to Open Ralph Kennedy Records

Brevard County,FL-Friday, (Dec, 4, 2009) Canaveral Port Authority has relented to the continuous pressure from Brevardwatchdogs.com and the demands of the public.

Today, I received verbal confirmation that an email requesting public records was sent staff-wide, from Stan Payne’s secretary, Donna Greenslade.

While the CPA’s cooperation is an indication of positive momentum in my pursuit of truth, this benchmark is only one of the crucial steps to obtaining the information which will lead to the truth behind Ralph Kennedy’s resignation.
Mrs. Greenslade was out for the afternoon, but I’ll be giving her a call on Monday morning, to get an estimated time of arrival for the records of Ralph Kennedy’s communication.
I’m guardedly optimistic that the CPA’s reluctant response is an indication that the process to clean corruption out of the Port has unofficially begun.

Payne recieves revised 119 form with shorter timeline

Brevard County, Florida, Wednesday, Dec. 2 – In an effort to expedite the process of obtaining public records, I shortened my 119 request to Canaveral Port Authority CEO  Stan Payne. The Brevard Watchdogs’ original 119 request to Canaveral Port Authority sought to

” Inspect, examine and copy any information with regard to Ralph Kennedy’s communication with any Canaveral Port Authority entity or person or any other entity or person.

This information should include, but not be limited to, any notes, memos, letters, emails, recordings and calendar appointment notations by you or any Canaveral Port Authority employee, commissioner or designee.

Today, I submitted a second 119 request to Mr. Payne, with a revised time line. In the spirit of diplomacy, and in hopes of expediting the recovery process , I shortened the request to the past five years (2005-2009). If I feel the need to extend the length and depth of my research, I will submit another request for the years 2000-2004. and continue the process as long as it takes in order to find the reason(s) for Ralph Kennedy’s abrupt resignation, which the CPA has refused to comment on.

Here is a copy of the letter I left for Stan Payne,earlier this afternoon:

This is a request under the Florida Public Records Law, Fla. Stat.Sec. 119.01 et seq.

I wish to inspect, examine and copy any information from the last five years (2005, 2006,2007,2008 and 2009) with regard to Ralph Kennedy’s communication with any Canaveral Port Authority entity or person or any other entity or person.
I trust that you and your attorney can now provide THIS PUBLIC INFORMATION without creating any “charges” to block or slow down the inspection of said documents.  This information should be readily available and its availability for public inspection, should be part of yours and your staffs duty as a civil servants.

This information should include, but not be limited to, any notes, memos, letters, emails, recordings and calendar appointment notations by you or any Canaveral Port Authority employee, commissioner or designee.

If any part of my request is denied, please let me know immediately, pursuant to FS 119.07(2)(a), giving the specific statutory citation for the exemption(s) from disclosure which you assert to justify your failure to make the requested information available.

Also, please state, with particularity, the reasons for your conclusion that the record(s) is (are) exempt.

If you determine that any part of or all of the records which I am requesting are not public records subject to public inspection, please note that FS 119.07(2)(c) provides that you shall not dispose of those records for a period of 30 days after the date on which you receive this letter.

If you determine that some portions of the requested material are exempt, please immediately provide me with the portion you deem non-exempt, pursuant to FS 1l9.07(2)(a).

Understand that I may challenge any assertion that portions of the requested information are exempt, and I’ve noted my delivery of this request on BrevardWatchdogs.com, so the public is aware of this request.

Dear Mr. Payne: Protect Port Canaveral & Update Brevard County Residents

An update for watchdog readers:

Today, I sent the following letter to Stan Payne, CEO of Canaveral Port Authority,

Dear Mr. Payne,

For several weeks now, the Canaveral Port Authority has remained silent about the abrupt resignation of commissioner Ralph Kennedy.
Residents of Brevard County, including Brevard Watchdogs, have eagerly awaited some form of public statement about the future of the commision.
Officials from Governor Charlie Crist’s office confirmed the fact that they’ve received 10 applications for Kennedy’s seat.

Conversely, the CPA, which you lead, has actively resisted to comply with our request for access to public information. I’ve attempted  to contact you through the proper channels at the Canaveral Port Authority, but you’re either too busy or don’t take Brevard Watchdogs seriously.
Perhaps you can take a few moments to answer the questions for the citizens of the community who are concerned about one of the major economic drivers in the area.
With great power comes great responsibility, and you have a responsibility to inform the public about Port Canaveral.

During this information lock-down, we want to know what your strategy is to maintain and ensure public confidence that the future economic health of the Port will be protected as the community prepares for the end of the shuttle program. Give us some words of confidence to entrust the supposed integrity of the Canaveral Port Authority.

What’s your message to the residents of Brevard County?

Due to your request (through your attorney) that the BWD pay in excess of $1500, we will reduce the request for inspection of documents to the years 2005,6,7,8,9

We trust that you will make these documents available for inspection early next week at no charge as these should be readily available.
